Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Cipherion Inc, a Texas corporation ("Cipherion", "we", "us", or "our"), governing your access to and use of the Cipherion DNS resolver service, website, and related services (collectively, the "Service").

By subscribing to or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service

Cipherion provides a dedicated DNS resolver service optimized for gaming and low-latency applications. The Service includes:

• Access to Cipherion's dedicated DNS resolver infrastructure
• IP address whitelisting for authorized DNS resolution
• Email-based account management and IP updates
• Access to the Cipherion subscriber portal at cipherioninc.com/manage

Subscriptions and Billing

Cipherion offers the following subscription plans:

• Monthly DNS Plan — $5.69/month, billed monthly
• Annual DNS Plan — $56.99/year, billed annually
• Streamer Tier — $9.99/month, billed monthly

All subscriptions include a 3-day free trial. You will not be charged during the trial period. After the trial, your selected plan rate applies automatically.

Subscriptions renew automatically at the end of each billing period. You authorize Cipherion to charge your payment method on file for each renewal period until you cancel.

If a payment fails, your IP will be removed from the whitelist immediately and DNS service will be suspended until payment is resolved.

Cancellation Policy

You may cancel your subscription at any time through your Stripe customer portal or by contacting us at support@cipherioninc.com.

• Cancellations take effect at the end of the current billing period
• Upon cancellation, your IP will be removed from the whitelist and DNS access will be terminated
• No refunds are issued for partial billing periods
• Annual plan cancellations are not eligible for prorated refunds

Acceptable Use Policy

You agree to use the Service only for lawful purposes. You may not use the Service to:

• Conduct DNS amplification attacks or any form of distributed denial-of-service attack
• Circumvent geographic restrictions or access controls
• Engage in any activity that violates applicable local, state, national, or international law
• Resell or sublicense access to the Service without written permission from Cipherion
• Share your whitelisted IP with unauthorized users
• Attempt to gain unauthorized access to Cipherion's infrastructure

Cipherion reserves the right to immediately terminate your access without notice or refund if you violate this Acceptable Use Policy.

IP Address Policy

Each subscription is tied to one (1) public WAN IP address. You may update your whitelisted IP address once every 30 days through the subscriber portal at cipherioninc.com/manage.

If your IP address changes more frequently due to your ISP's dynamic IP assignment, please contact us at support@cipherioninc.com to discuss accommodations.

Sharing your subscription with multiple households or IP addresses is not permitted under a single subscription plan.

Service Availability

Cipherion makes reasonable efforts to maintain high availability of the DNS resolver service. However, we do not guarantee 100% uptime and are not liable for interruptions caused by:

• Scheduled or emergency maintenance
• Infrastructure failures beyond our reasonable control
• Force majeure events including natural disasters, acts of government, or network outages
• Your own internet service provider's issues

Privacy

By using the Service, you acknowledge that Cipherion collects and stores your email address, public IP address, and subscription information for the purpose of providing and managing the Service.

Cipherion does not sell your personal information to third parties. DNS query logs may be retained for security and operational purposes. We do not log the content of DNS queries for marketing purposes.

Payment processing is handled by Stripe. Cipherion does not store credit card information.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Cipherion does not warrant that the Service will improve your in-game performance, reduce lag, or produce any specific gaming outcome. Results may vary based on your internet service provider, hardware, game server location, and other factors outside Cipherion's control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CIPHERION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Cipherion's total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to Cipherion in the 30 days preceding the claim.

Modifications to Terms

Cipherion reserves the right to modify these Terms at any time. We will notify subscribers of material changes via email to the address on file. Continued use of the Service after notification constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dallas County, Texas.
